Under the current legislation, as long as you have the status of consumer and user, you have the right to withdraw from this contract without having to justify your decision and without penalty of any kind.
To exercise the right of withdrawal, you must notify us in writing of your unequivocal decision in this regard, without having to justify your decision, within a maximum period of 14 (fourteen) calendar days from the day (i) that you or the third party that you had indicated- received the good object of the contract (ii) and / or that you reimburse us. Of course, this right of withdrawal can be exercised prior to receiving the good object of the contract, if such is your will.
For the purposes of correctly understanding the right of withdrawal the delivery of the goods and / or the transfer of the document must occur, in any case, at the registered office of TORROT ELECTRIC EUROPA, SL, located at c / Unicef, nº 17, Torremirona Industrial Estate, 17190 – Salt (Girona)
The withdrawal document must necessarily express, if applicable, the following points, as a minimum: (i) the name and address of the person who exercises it (ii) the identification data of the contract by, at least, the date and object of the same (iii) the will, unequivocal and clear, to cancel the contract.
Since the exercise of the right of withdrawal should not imply any expense for you, we will return all the payments you have made to us plus the delivery costs and the necessary and useful expenses that you would have made in the good. In no case should you reimburse any amount for the decrease in the value of the good derived from wear or deterioration caused by its correct and proper use.
The return of payments and expenses will be made without undue delay and, in any case, before 14 (fourteen) calendar days have elapsed since the date on which you informed us of the decision to withdraw from the contract. After this period has elapsed without you having recovered the amount owed, you will have the right not only to demand a duplicate payment, but also to demand compensation for the damages that may have been caused to you in excess of said amount.
The impossibility for you to return the property for loss, destruction or other cause will not deprive you of the possibility of exercising the right of withdrawal, although in cases where the impossibility of return is imputable, you will be liable for the value of the same.
